Auburn's FLSA Response Aims to Minimize Future Disruptions for Employees


Last year, Auburn University and Auburn University-Montgomery (AUM) took significant steps to address planned changes in the Fair Labor Standards Act (FLSA).

On April 23, 2024, the Department of Labor (DOL) announced a significant change to the FLSA’s minimum salary threshold ($35,568) for overtime eligibility. This change was scheduled in phases:

  • Phase 1, which took effect on June 30, 2024, saw over 150 employees' positions redesignated to FLSA-nonexempt due to their salaries falling below the initial threshold of $43,888 set by the U.S. Department of Labor (DOL). 

  • Phase 2, which was scheduled for Dec. 1, 2024, would have increased the threshold to $58,656 and impacted several hundred employees. However, the FLSA change was vacated by a federal judge on Nov. 15, 2024. As a result, the federal threshold remains at $35,568.

Our Response

Auburn and AUM implemented an overtime exemption threshold of $44,000 — higher than the federal threshold. Employees who make under $44,000 annually continue to have their positions designated as nonexempt. 

Implementing this threshold helps maintain stability for employees who were impacted by the June 30 change and ensures that Auburn and AUM stay ahead of any potential legal developments. Employees who make below $44,000: 

  • Receive overtime premium for all hours worked over 40 in a workweek.  

  • Must record their time worked through Kronos.  

  • Are paid biweekly (every two weeks) rather than monthly.   

The Compensation and Classification team worked closely with campus leaders throughout this process to help minimize disruptions and provide support to employees.
